Terms of Service

Plain-language terms governing your use of the Bonfiyah app and website. By installing or using Bonfiyah, you agree to these terms.

1. Who we are

Bonfiyah is operated by Bonfiyah, Inc., a Delaware corporation. Contact: [email protected].

2. Your account

You're responsible for keeping your account credentials safe and for what happens under your account. If you suspect your account has been accessed by someone else, email us at the address above immediately.

3. Subscriptions and billing

Subscriptions are billed by Apple via your App Store account. Pricing is shown on the paywall before purchase. Free trials, if offered, convert to paid subscriptions automatically unless you cancel before the trial ends. To cancel, go to your iPhone's Settings → your Apple ID → Subscriptions, or use Bonfiyah's "Manage Subscription" link, which deep-links to the same Apple-managed page.

Refunds are processed by Apple, not by us — request a refund through reportaproblem.apple.com. We can advocate for your refund with Apple if there's a specific reason; email us.

4. Your content

You own everything you record, transcribe, and produce in Bonfiyah. We do not claim any rights to your audio, transcripts, summaries, or notes. We do not use your content to train any AI model.

5. Acceptable use

You agree not to use Bonfiyah to record people without the consent required by your jurisdiction, to attempt to reverse-engineer the app, to interfere with our backend services, or to do anything else that would be illegal or harmful. Recording laws vary by state and country. Bonfiyah gives you the tools to track per-person consent, redact non-consenting speakers from any export, and delete content on request — but the responsibility for the legality of any specific recording is yours.

5a. HIPAA and protected health information

Bonfiyah is not a HIPAA Business Associate and we do not currently offer Business Associate Agreements. While we build to HIPAA-aligned data-handling principles, covered entities and business associates must not use Bonfiyah to capture, transmit, or store Protected Health Information without first conducting their own compliance review. 5b. Your representation about lawful basis to record

You represent and warrant that, each time you initiate a recording in Bonfiyah, (i) you have a lawful basis under the law of every jurisdiction in which the participants in the conversation are located to record the conversation and to process the conversation through Bonfiyah's third-party AI service providers (AssemblyAI for transcription and Anthropic for AI inference); (ii) you have obtained the consent or provided the notice that applicable law requires from every speaker who appears in the recording; and (iii) the recording does not violate any court order, restraining order, no-contact order, fiduciary duty, employment agreement, or contractual obligation to which you are subject.

You agree to indemnify, defend, and hold harmless Bonfiyah, Inc., its officers, directors, employees, and contractors, against any claim, lawsuit, regulatory action, fine, settlement, or expense (including reasonable attorneys' fees) brought against any of them by a third party arising from your use of Bonfiyah to record, transcribe, or analyze a conversation, where the claim asserts that the recording, transcription, or analysis was unlawful, unauthorized, or in breach of the third party's rights. Bonfiyah will provide you with reasonable notice of any such claim and reasonable cooperation in the defense.

5c. Prohibited uses

You agree NOT to use Bonfiyah to:

  • Record a person whom you know is or could reasonably be in fear of your conduct, including a current or former intimate partner who has expressed they do not wish to be recorded.
  • Record a person who is, or may be, the subject of a protective order, restraining order, no-contact order, or similar legal instrument relating to you.
  • Record a person under circumstances that would constitute stalking, harassment, intimate-partner surveillance, or coercive control under any applicable law.
  • Record a person under the age of 18 without the consent of a parent or guardian, where the recording captures information about that minor — whether the minor is a primary participant or only audible in the background.
  • Use any output of Bonfiyah — including transcripts, AI summaries, personality analyses (Mach-IV, Big Five, DISC, MBTI Compatibility, Pointillist Painting, Belbin, Thomas-Kilmann, Cognitive Style, Predictive Index), or compatibility scores — as the sole or substantial basis for any decision regarding another person's employment, housing, education, credit, insurance, healthcare, custody, immigration, or similar consequential outcome.
  • Use any output of Bonfiyah outside the conversational context in which the underlying recording occurred, in a manner that results in detrimental or unfavourable treatment of any person. (This restriction aligns with Article 5(1)(c) of the European Union's Artificial Intelligence Act, the Colorado Artificial Intelligence Act, NYC Local Law 144, and parallel state civil rights laws.)

Violation of this Section 5c is a material breach. Bonfiyah may terminate your account immediately, refuse refunds, preserve evidence of the violation in our audit log, and cooperate with law enforcement. Your obligations under Section 5b (indemnification) survive any termination for breach of this Section 5c.

6. AI features

Pro AI features (Promise Tracker, Truth Layer, Pre-Brief, People Memory, Story Mode, Speaker Themes, action-item extraction) generate outputs based on inference over your transcripts. The outputs are best-effort; you should not rely on them as a substitute for your own judgment. Bonfiyah is not a medical, legal, financial, or other professional advisor; outputs are not professional advice.

7. Limitations of liability

To the maximum extent permitted by law, Bonfiyah, Inc.'s total cumulative liability to you for any claim arising out of these terms or your use of Bonfiyah is limited to the greater of (a) the amount you've paid Bonfiyah, Inc. in the twelve (12) months preceding the claim, or (b) one hundred United States dollars (US$100). We're not liable for indirect, consequential, special, punitive, or exemplary damages, including lost profits, lost data, or business interruption, even if we have been advised of the possibility of those damages. Nothing in this Section limits liability for fraud, willful misconduct, gross negligence, or any liability that cannot be limited under applicable law.

8. Termination

You can stop using Bonfiyah at any time and delete your account through Settings → Privacy → Delete My Data. We can suspend or terminate accounts that violate these terms, with notice and a chance to fix the issue except in cases of clear abuse.

9. Governing law

These terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Delaware, and you and we both consent to jurisdiction there.

10. Changes

If we change these terms in a material way, we'll notify you in-app and by email at least 14 days before the changes take effect. Continued use of Bonfiyah after a change means you accept the new terms.
